Buying and/or participating in any Magesc sales means automatic acceptance and agreement of the following Terms and Conditions.
Your responsibility is to abide by these terms.
Please become familiar with our T&C.

These terms are effective as of August 1, 2019

Introduction

First and foremost, thank you for purchasing an adoptable Magesc character, we appreciate your business!

The Terms and Conditions outlines important rights for owning the adopt! All Magesc races are a closed species owned by Skyeforge (E. Justin Peterson) and are not to be made without express permission from me. When purchasing an adopt or items from Magesc or when deciding to make your own (MYO), you are purchasing partial rights to the adopt. These partial rights are for personal use only.

I reserve the right to make changes to the Terms and Conditions at any time for any reason with proper announcements being made at the top of this page and on Discord.

General conduct and regulations of commerce

General Conduct

DO NOT STEAL, USE, EDIT, HEAVILY TRACE, AND/OR HEAVILY REFERENCE.
- Usage and Editing are reserved only for those who have purchased a character.

ABSOLUTELY DO NOT HARASS MAGESC ADOPT OWNERS OR STAFF.
- This includes: begging for free characters or items, constantly asking to buy a character after being given a “no”, guilt-tripping others for having too many characters or being 'unfair', and so forth.
- I cannot stress this enough. You do not have the right to harass anyone in the Magesc community.
- If anyone feels threatened, harassed or uncomfortable, please bring it up to me, Skyeforge, or other staff members in private. Send the group a note or to one of us individually. Please do not make the issue public until all parties have been thoroughly talked to. We are here to help.
NO RE-SELLING OR TRADING OF CHARACTERS MAY OCCUR AT ANY TIME.
- Anyone caught re-selling or trading will automatically be blacklisted and no longer allowed in the community.
  - We have a special buyback program for unwanted characters for this very reason.
- The only item one may trade/give to another person is Dragon Souls, Dragon Tears, and Zil (Magesc currencies) with consent from both parties and at their own risk.
  - Magesc staff is not responsible for trades that occur that one party feels is unfair. Both parties must consent prior to the trade being executed and, once completed, is final unless both parties consent to trade back.
Please be courteous and read through this entire T&C.
- I understand that this is a block of text but it has been divided into sections for easier reading.
- Please take the time to familiarize yourself with these rules as they are important.

Buying an Adoptable

All sales will occur on this website, our Discord server, GaiaOnline, Dappervolk, Toyhouse, or the Magesc forums.
- Direct sales will be made under the usernames World of Magesc or Skyeforge.
- If any questions occur about the validity of a "Magesc sale" by another user, please forward them to me personally.
All payments will be made using PayPal via an invoice sent to you from [email protected] in USD.
- Any invoices sent from other accounts claiming it be for a Magesc sale may be fraudulent. Please be sure to speak to staff immediately if you feel it may be fraudulent. If so, please report/disregard the invoice.
You can buy a character as a gift for someone else if you desire, but once you have gifted the character to another person, it is theirs and you no longer have any claim over the character or their design.
Failure to pay an invoice within 48 hours of winning an auction/buying an adopt will result in a warning and further offenses will result in a ban from rights to the species altogether.
ALL SALES ARE FINAL!
- We will only give refunds to those who's art is unable to be completed due to an artist's schedule at the expense of the artist.
- Please be 100% sure you wish to purchase any character before doing so.

Dragon Soul Purchases

Dragon Souls are the currency used in Magesc and are purchased from this website, our Discord server, or the Magesc forums.
- These souls will be logged in a persons universal inventory and may be used to purchase growths of their characters and other items from the in-game shop, Peddler's Rock.
AGAIN, ALL SALES ARE FINAL!
- No refunds will be given at any time unless otherwise stated by Skyeforge in writing to the consumer.
- Please be 100% sure you wish to purchase the items before placing an order.

consumer usage and guidelines

Limitations of Ownership

Every individual may own as many characters as they wish with no limits.
- This is, however, dependent upon the type of sale. Some sales will be "newcomers only".
Co-Owning is NEVER accepted at Magesc.

General Usage

Once you have purchased, won, or received the adoptable, you own the rights to it, meaning you may use it to how you would like with some restrictions.

You own the design but not the species. I, Skyeforge, own the species concepts.

Design Changes or Editing:
- You MAY NOT change the design/adoptable to the point of it being non-recognizable.
  - Most traits listed in the "PHYSICAL CHARACTERISTICS" tab of the species profile cannot to be changed, as they are critical to that species.
- You MAY change the design/adoptable's clothes, accessories, and hairstyle.
You are allowed to re-post the image of the design/adoptable anywhere (personal website, deviantArt, toyhou.se, tumblr, facebook, etc,)
- HOWEVER, you must credit me (Skyeforge) for the concept and the artist who drew it AT ALL TIMES. Linking back to this website's home page is also a nice addition if you wish to do so, but not required.
You MAY draw your new design/adoptable and commission/request your design/adoptable to be drawn by other artists.
- Credit is not required in these instances but I, Skyeforge, would love to be tagged in the pictures that have been drawn just to see them!

Personal Usage

You are encouraged to use the design/adoptable PERSONALLY as your persona, character in role plays, and/or your own unpublished stories.

Commercial Use

The buyer must disclose any intentions of commercial use and request it from the original artist and myself prior.
- Commercial rights do not entail the right to use the Magesc name, art, or lore commercially. This right is reserved for Skyeforge only.

third party rights

Here at Magesc there are a few third party websites we utilize for our services, such as GaiaOnline, Dappervolk, ToyHouse, ProBoards and Discord. If you are creating an account on any of these third party websites, you acknowledge that you have read, understood, and agree to the terms and conditions set up by these third parties. Third party websites are simply there as a platform for meeting or role playing and in no way are affiliated with Magesc and are not responsible for anything held within these terms and conditions. This agreement is between you and Magesc only and not affiliated with any other website or entity.

disclaimer and closing statements

I, Skyeforge (E. Justin Peterson), reserve no rights of devil horns/tails, angel wings, or dragons, their wings, or horns. I also reserve no rights of images used on the role play forum unless they are drawn by the artists hired by Magesc. I do, however, reserve the rights to the concepts, lore, and written world associated with Magesc as they are my own creation and concept unless otherwise stated. I reserve the right to use the art created in the name of Magesc on this website -- and any third party sites Magesc utilizes -- to showcase characters associated with the world of Magesc with proper credit. Of course. I, along with my group including admins, managers, and contributors have all helped fill the world of Magesc. We are here to help you with any questions or concerns and bring a fun community together.

I am not responsible from any consequences resulting from failure to read the Terms and Conditions.
